Inder Lynch Lawyers Limited (we, us) is an Auckland law firm with offices in Manukau City, Pukekohe and Papakura. We provide a range of legal services, including but not limited to commercial law, property law, civil litigation and dispute resolution, trusts, and estate planning and administration.

As a law firm, we routinely collect significant personal information. This document sets out how and why we collect personal information, the ways in which we use it, the circumstances in which we may disclose it, our retention policies and your rights of access and correction. 

Collection of personal information

Personal information is defined in the Privacy Act 2020 as information about an identifiable person. 

The types of personal information that we may collect from clients and prospective clients include, but are not limited to, an individual’s:

  • Full name and date of birth;
  • Nationality;
  • Addresses (physical, postal and electronic) and telephone numbers;
  • Employment details;
  • Bank account details and taxpayer identification numbers; and
  • Source of wealth and/or source of funds information (for certain types of matters).

We will usually collect personal information directly from you, either through initial contact that you may have with us through our website or via telephone, or through our formal client on-boarding process. With your consent, we may also collect personal information through third-party sources.

We may also collect personal information from publicly available sources (for example, the Companies Register). 

How we use personal information

We will generally use personal information for the specific purposes for which it was collected.

We collect personal information so that we can:

  • Communicate with our clients and prospective clients;
  • Effectively provide legal services; and
  • Market the services that we offer.

We also use the personal information that we collect so that we can comply with specific obligations placed on us by law, including our obligations under:

  • the Lawyers and Conveyancers Act 2006 and the associated rules of professional conduct made under that Act;
  • the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 to verify the identity of persons who instruct us to do legal work, and in some cases, to obtain details about a client’s source of wealth and/or source of funds; and
  • the United States Foreign Account Tax Compliance Act (FATCA) and the OECD Common Reporting Standard (CRS), as embodied in New Zealand’s domestic legislation.

Disclosure of personal information

Besides our staff, we may also disclose your personal information to:

  • any person or entity to whom you have authorised us to make disclosure;
  • any third-party service providers that assist 
  • a government agency, our AML/CFT sector regulator or a law enforcement agency such as the New Zealand Police if we are required to do so by law;
  • any other party if we are lawfully required to do so by a court of competent jurisdiction.

Retention of personal information

We take all reasonable steps to safely and securely store the personal information that we collect. These include, among other things, storing client documents and correspondence in our secure electronic document management system, ensuring that access to our systems is restricted to current staff and protected by two-factor authentication, and utilising the services of an external information technology provider to maintain the overall security of our network and systems.

We will keep personal information for as long as is required by the law or for the specific purposes for which we gathered the information. Once any applicable legal retention period has expired, we will securely destroy or delete (in the case of electronic information) the information.

Access and correction

Subject to any applicable exceptions under the law, you have the right to ask for a copy of any personal information that we hold about you, and to ask for it to be corrected if you think that it is wrong.

We will respond to any request for access to or correction of personal information within 20 working days of the request being received by us, unless an extension of time is required to furnish a proper response. We may charge a reasonable fee for access to documents, which will be notified before the request is actioned and any fee is incurred.

Use of Google Analytics

We use Google Analytics to monitor and analyse our website traffic. Google Analytics works by storing small data files, known as “cookies”, on users’ computers. All website data is reported to us in the aggregate and we do not (and cannot) track how any specific individual user has accessed our website.

Secure payment gateway

We use a third-party payment processor, Windcave, to provide a secure facility on our website for making payments of our invoices via credit card.

When you make an online payment through our website, the transaction is processed directly by Windcave. We do not see or retain any credit card information such as credit card numbers, CVV codes or expiry dates.
