Purchasing Rural Land

Obtaining a Regional Council LIM

When purchasing rural land we strongly recommend not only making enquiries with the District Council but also obtaining a Land Information Memorandum from the Regional Council. A suggested clause for insertion in the purchase agreement is:

“This agreement is conditional on the purchaser consulting the relevant Regional Council and being satisfied, on or before (date), that:

  1. all resource consents necessary for the conduct of the business that the purchaser intends to carry out on the property, have been granted and are current;
  2. there are no unsatisfied Regional Council compliance requirements for the property or the business conducted on the property, in relation to resource consents or otherwise; and
  3. there is nothing likely to adversely affect, in the future, either the property or the business that the purchaser intends to carry out on the property.”
