Properties used as “P” Labs – Designation on the Property LIM
The use of “P” (methamphetamine) is a scourge on our Society. However, for the criminal class, it is highly profitable. They will frequently turn properties into production laboratories with the result that those properties become contaminated with the chemicals used in the “P” production.
We have undertaken a review of the policies of the various Councils in the Auckland region in respect to such identified contamination. Although the policies are not identical, we can summarise the general approach as:
- The Police will normally notify the Council when a “P” lab is discovered;
- If the Council is aware that the property is or was the site of a “P” lab it will record that information on the Land Information Memorandum (“LIM”) for that property;
- A cleansing order will be issued on the owner of the property;
- The designation of the “P” lab and the contamination on the LIM may not be removed, even if the cleansing order is satisfied.
The above is a general summary only. If a “P” lab situation arises with your rental property, you need to check your Council’s specific policy.
A continued designation on your property’s LIM may significantly reduce the value of your property.
